The Federal Trade Commission (FTC) has filed a lawsuit against Innovative Partners, LP (doing business as Innovative Health Plan and Healthcare Plan) and American Collective, LP (doing business as ACLP Health Plan) for deceptively marketing non-comprehensive medical discount memberships and limited benefit plans as comprehensive health insurance or PPOs.
If you were enrolled in an Innovative Partners or American Collective plan at any time during 2026, you may be eligible to enroll in Marketplace coverage, even if your plan was canceled prior to the FTC’s lawsuit.
To mitigate the impact on consumers who may be left without actual health insurance, the Centers for Medicare & Medicaid Services (CMS) and CCIIO have approved a time-limited SEP to allow impacted individuals to transition into comprehensive Marketplace coverage. The FTC began actively mailing notices to affected consumers June 11, 2026.
Summary of the Special Enrollment Period (SEP):
- Who Qualifies: Any resident enrolled in an Innovative Partners or American Collective plan at any time during 2026 (even if the plan has already been canceled).
- Enrollment Timeline: Affected consumers have from June 11, 2026, through Monday, August 10, 2026, to enroll in a Marketplace plan.
- Effective Dates: Coverage can begin prospectively on the first day of the month after plan selection. Additionally, consumers may request retroactive coverage through the Marketplace Call Center to cover medical needs earlier in 2026 (subject to paying retroactive monthly premiums).
How Consumers Apply:
Consumers are instructed to apply via HealthCare.gov using the email address associated with their original fraudulent account.
- Online: Consumers should complete a 2026 application. If they receive an automated message saying open enrollment has closed, they should proceed. Roughly 4 days after submission, they can log back in, select "Report a Life Change," and the SEP will automatically populate.
- By Phone (Recommended): Consumers can call the Marketplace Call Center at 1-800-318-2596 (TTY: 1-855-889-4325) and state they are an "Innovative Partners or American Collective customer" to have their identity verified against the FTC's consumer list and get immediate assistance with the SEP.
