File an Insurance Complaint

If you already have an outstanding complaint filed with the Kansas Department of Insurance regarding your current issue, please do not complete a new complaint form. Instead, contact the Consumer Division: 800-432-2484 or 785-296-3071.

The Insurance Commissioner’s Consumer Assistance Division is here to assist Kansas insurance consumers. To file a consumer complaint against an insurance company/agent/agency, simply follow this three-step process:

Select the following link and you will be taken to the Kansas online complaint form. Please have the following information available before starting:
- Your name, address, telephone number, and email (Note: if your email address has special characters, such as underscores, please provide it in the “Details of Complaint” section and not in the specified email field)
- Name of the insurance company/agent/agency involved in the complaint
- Policy or claim number (if applicable)
- Type of insurance involved (auto, home, life, etc.)
- A description of the complaint
After filling out the form and selecting the Review Complaint button, you will be presented with a screen confirming the information you provided (Note: your complaint has not yet been submitted at this point). Please review this information carefully, check the box indicating that you agree with the acknowledgment statement, and then select the Submit Complaint button.
You will then be presented with a final page that will provide you with your complaint case number as well as an ability to download a PDF of your complaint information. You will also have the ability at this point to upload any supporting documents that deal with the complaint. You will then be contacted by a Kansas Insurance Department consumer representative if necessary.

Alternatively, if you would prefer to not complete the form online, you may download our fillable Consumer Complaint Form or Formulario de Quejas del Consumidor and email the completed form to KDOI.complaints@ks.gov or print the completed form and mail or fax to our office. If you need to send additional information pertaining to your complaint, please send by fax (785) 296-5806 or email KDOI.complaints@ks.gov and reference your file number.

This form is provided by the Kansas Department of Insurance to help individuals report securities violations, fraud or misconduct in the financial markets.

Important Information

Before filing a complaint, please contact your broker-dealer or investment adviser to confirm your concern is not considered a typical market loss on an investment.

If your concern falls within the jurisdiction of the Kansas Department of Insurance, Securities Division, please provide accurate and detailed information to help us investigate your complaint thoroughly.

Report Financial Exploitation

Beginning July 1, 2024, when your firm’s agents, investment adviser representatives, or other persons serving in a supervisory, compliance, or legal capacity learn of circumstances making them reasonably suspect that an elder or vulnerable adult is being financially exploited in Kansas, your firm has an obligation to report.

First, your firm must report the suspected financial exploitation to the Compliance, Enforcement and Anti-Fraud Division of the Kansas Department of Insurance and to Kansas Adult Protective Services, a division of the Department of Children and Families.

Second, pursuant to the Protect Vulnerable Adults from Financial Exploitation Act, your firm may delay a transaction or disbursement if, after reviewing the requested transaction or disbursement, you reasonably believe it may further financial exploitation of an elder or vulnerable adult.

If your firm delays, then you must report the suspected exploitation and the delay immediately (using this form). Please see K.S.A. 17-12a412, 44-1017a, and 58-3065 for more information. Insurance fraud is one of the most costly white-collar crimes in America, second only to tax evasion. It affects every citizen of Kansas immediately and substantially.

While shoplifting costs the retail industry approximately $13 billion each year, insurance fraud is estimated to cost $100 billion. In both instances, the crimes translate into higher costs for everyone. Insurance researchers estimate that the average U.S. person pays up to an additional $932 a year in higher premiums to offset fraudulent claims.

Fake insurance policies are scams designed to steal your money. Fighting fake insurance is simple. “Stop. Call. Confirm.” before you buy. Check to see if your Insurance Agent or Company is licensed in the state of Kansas through the SBS Lookup Portal.

Reporting Insurance Fraud

The Kansas Insurance Commissioner has designated the National Association of Insurance Commissioners (NAIC) Online Fraud Reporting System as the prescribed form to report fraudulent insurance acts in the state. Follow the link to access the service.
